The EA are employers just as any other organisation who under UK law are
responsible and accountable for the actions of their employees and sub
contractors be it Health and Safety or Environmental issues - so I
really don't see any precedent being set, only the law being enacted as
it should have been. The only thing unique was the fact the EA could not
take themselves to court.

Um, what has his leg to do with the environment?

It was a precedent, which means that if you want to go after the UK
government because they transposed RoHS into UK law on the basis that
the
replacement materials you are forced to now solder with are
environmentally
more damaging, you will actually be able to aregue this case as a
precedent.
If you want to do that have at it.

I was just flagging the legal position without stating the obvious -
which I
have now done.

You somewhat sensationalise it.......... any organisation is responsible
for the actions of their contractors - the EA lapsed in this
responsibility. If the contractor had fallen off a ladder and killed
himself then the EA would again have been in the dock..........

Speaking of the environment, I believe a precedent was set today in
England,
but I am sure this will not be the last case ...



I believe that this court settlement sets a European precedent for an
environmental agency being taken to court over environmental
damage.....and
losing the case
