Rick - "put on the market" does not necessarily mean "buying and selling" so be careful there.
However I agree in principle that non-RoHS may be warranty replaced, service repaired with non-RoHS parts/items and non-RoHS may be resold second hand if previously placed on the market prior to July 06.

I tend to disagree with you with regard to warranty replacements and/or repairs, these items are usually not "put on the market" ever, they are like-for-like exchanges/ replacements for products that failed under warranty and are typically exchanged free of charge or with some sort of pro-rated expense. Here is the def of "Market" from Websters, even a lawyer would have to agree "put on the market" means buying and selling. There is no EU limit for free stuff...

"Put On the Market" simply means any equipment - New or Refurbished. The
intent is that after July 1, 2006, all EEE entering EU markets be
lead-free technology. Using this intent will help remove all these
arguments and efforts by people who are trying to beat the RoHS and WEEE
directives. That is what I am requesting my customers to follow. It
simplifies the life of the engineering folks (includes this writer) a
lot, reduces useless arguments, saves time and gets the product out the
door.
