Rick - "put on the market" does not necessarily mean "buying and selling" so be careful there.

However I agree in principle that non-RoHS may be warranty replaced, service repaired with non-RoHS parts/items and non-RoHS may be resold second hand if previously placed on the market prior to July 06.

Regards,

Chris

Pratap,

I tend to disagree with you with regard to warranty replacements and/or repairs, these items are usually not "put on the market" ever, they are like-for-like exchanges/ replacements for products that failed under warranty and are typically exchanged free of charge or with some sort of pro-rated expense. Here is the def of "Market" from Websters, even a lawyer would have to agree "put on the market" means buying and selling. There is no EU limit for free stuff...

WEBSETRS DEF OF MARKET:

Main Entry: 1mar·ket

Pronunciation: 'mär-k&t

Function: noun

Usage: often attributive

Etymology: Middle English, from Old North French, from Latin mercatus trade, marketplace, from mercari to trade, from merc-, merx merchandise

1 a (1) : a meeting together of people for the purpose of trade by private purchase and sale and usually not by auction (2) : the people assembled at such a meeting b (1) : a public place where a market is held; especially : a place where provisions are sold at wholesale <a farmers' market> (2) : a retail establishment usually of a specified kind <a fish market>

2 archaic : the act or an instance of buying and selling

3 : the rate or price offered for a commodity or security

4 a (1) : a geographical area of demand for commodities or services (2) : a specified category of potential buyers <the youth market> b : the course of commercial activity by which the exchange of commodities is effected : extent of demand <the market is dull> c (1) : an opportunity for selling <a good market for used cars> (2) : the available supply of or potential demand for specified goods or services <the labor market> d : the area of economic activity in which buyers and sellers come together and the forces of supply and demand affect prices <producing goods for market rather than for consumption>

- in the market : in the position of being a potential buyer <in the market for a house>

- on the market : available for purchase also : up for sale <put their house on the market>

"Put On the Market" simply means any equipment - New or Refurbished. The

intent is that after July 1, 2006, all EEE entering EU markets be

lead-free technology. Using this intent will help remove all these

arguments and efforts by people who are trying to beat the RoHS and WEEE

directives. That is what I am requesting my customers to follow. It

simplifies the life of the engineering folks (includes this writer) a

lot, reduces useless arguments, saves time and gets the product out the

door.
