I agree with Dave.
They may be exempt (temporarily) due to service reliability concerns, but if
network TEST equipment fails, that is probably not going to cause a network
outage unlike when actual network equipment fails, therefore, I doubt if you
are exempt.  Unless your equipment is running in line with the network
equipment and sends alarms, etc, in real time when problems occur.  Then
maybe it would be important for you to tag along on the exemption.
But don't take our word for it...

Just because some of your customers are TEMPorarily exempted (2010) doesn't
mean you can leap onto their temporary exemption.
