You haven't said what sort of problem you're getting although the 
assembly does not look good either from a mechanical or a EMC point of 
view. I'm not aware of any design guidelines or standards that would 
forbid this arrangement but common sense should tell the designer that 
this arrangement is not good from either point of view.
