The first question is, does your contract for the work require Mil Spec? If it does then it is a closed issue and you can't waiver it. (Sure you figured that that much) I don't think you should have to waive it because of their short comings. They are trying to cover their tail when they have a scale in their drill or image. I try to work with the manufacturer as much as possible, but there are some things you don't budge on. I believe this is one of them. At least have them cross section one of the boards to verify this.
