On November 20, 2007 the Department of Homeland Security published the
final Appendix A - Chemical of Interest List of the Chemical Facility
Anti-terrorism Standards in the Federal Register. This means that any
facility that possesses any of the chemicals listed in Appendix A at or
above the Screening Threshold Quantity (STQ) will have 60 calendar days
from November 20, 2007 to submit to DHS a Top Screen Questionnaire.
Chemicals listed that are commonly used by PCB manufacturers include
sodium chlorate, chlorine, formaldehyde, hydrogen peroxide, and nitric
acid. 

 

The information collected from the Top Screen process is just one of
several factors that DHS will consider to determine whether a given
facility poses a significant level of security risk. If DHS determines
through evaluation of the Top Screen and other intelligence information
that a facility does in fact pose a significant security risk, the
facility will be designated a "covered facility" and prioritized into
one of four risk tiers. The plant's ranking will be kept confidential
and therefore unavailable to the company or public. Covered facilities
will have to submit to DHS a security vulnerability assessment within 90
days of the determination, and a site security plan within 120 days of
the determination. The DHS will conduct mandatory audits and inspections
to monitor compliance, and has the authority to shut down facilities
that fail to comply with the rule.
