ERA attended the stakeholder meeting regarding the review of RoHS in
Brussels in July.  It was clear that Ecolas, the consultants undertaking
this study for the Commission, had received very little feedback to
their rather complex questionnaire distributed earlier in the year.  To
try and get more substantive feedback, Ecolas has issued a second
simplified questionnaire. I don't believe the IPC list server supports
attachments but I would be pleased to copy the Ecolas questionnaire
documents to anyone who asks or you can contact Ecolas direct.
 
The review of RoHS is looking at a very wide range of options and it is
important that industry gives the Commission its views on the impact of
RoHS and WEEE and how it could be improved.  You will all be aware of
the widespread criticism of RoHS from many quarters and regarding many
issues; scope, definitions, harmonisation, exemptions process, impact of
alternative substances etc.  Similarly WEEE has had many issues;
multiple registration and requirements, scope etc. 
 
Now is the opportunity to contribute instances specific to your
organisation of problems (or even opportunities) that arose and
proposals for improvement.
 
I would suggest forwarding this email and encouraging your industry
contacts to reply to Ecolas.

Subject: European Commission study on RoHS/WEEE


Dear all,
 
Research teams from Arcadis ECOLAS and RPA are contracted to conduct the
"Study on Directives 2002/95/EC on the Restriction of the Use of Certain
Hazardous Substances (RoHS) and 2002/96/EC on Waste Electrical and
Electronic Equipment (WEEE)". As mentioned in the accompanying European
Commission letter, the RoHS and WEEE Directives are included in the
simplification exercise for 2008. The objective is to make legislation
less burdensome, easier to apply and thereby more effective in achieving
its goals.
 
The questionnaires in attachment have been developed as a part of this
study, which can be split into a RoHS and a WEEE part: 

*	The study on RoHS consists mainly of an analysis of the economic
and environmental impacts of the RoHS Directive (Cost-Benefit Analysis).
Relevant topics are resource costs and staffing requirements of
communication, monitoring and review, exemption procedures and
enforcement.  
*	The study on WEEE mainly assesses impacts on innovation and
competition and is directed only to the MS of Lithuania, Germany, UK,
Ireland and Belgium. 

In Spring, an earlier questionnaire was distributed. If you already
responded at that time: thank you for your effort - this message is not
relevant for you. However, it is possible that we take contact with you
individually for a correct interpretation of your response.
 
In order to maximise response, the original questionnaire dedicated to
individual companies has been revised, the two seperate questionnaires
have been integrated into one, questions have become less detailed and
more room is given to express your views. In response to your request,
the deadline has been substantially extended. 
 
The focus lies on the following product groups: refrigerators, PC and
laptop (incl. spare parts), printers and copiers, cellphones, television
sets, clocks and watches, fluorescent lamps (straight and compact), lawn
mowers and gardening equipment, video games, dispensers for hot and cold
beverages. However, information on other product groups regarding RoHS
compliance will also be incorporated in the report. 
 
If you are an individual company: 

*	If you haven't given any response yet during the Spring
exercise, please consider the questionnaire designed for individual
companies. 
*	Please forward the questionnaire designed for individual
companies to your suppliers. 
*	Experience with the first version of the questionnaire showed
that the non-disclosure agreement (example see attachment) was
considered very useful. Please make use of it or adapt it to your
wishes.

If you are a trade association, please forward the questionnaire
designed for individual companies on our behalf (we would be glad to
receive a list of the companies that received our e-mail). If you
haven't given any response yet during the Spring exercise, please
consider the questionnaire designed for trade associations.
 
We would be grateful if you could contribute to our study by providing
insights to the issues. The insights provided will be utilised
anonymously in the study report and will be treated as confidential. We
would also be happy to contact you via phone.
