Pete is right

We ought not get into a discussion about how your certain EU
legislation would be hugely expensive, ineffective, inhibit development,
reduce available markets, is thinly veiled protectionism and de-facto global legislation.

Let's be realistic - US legislators are just as political as their EU counterparts and they are not going to do what is right if it mighti in anyway be controversial with their consituents. And after the last election we know which way they lean.
