Genny

I tried to find this blue book. Can you give me the address where I can get it?

Always looking for the loophole...
No that is not acceptable. From the "Blue Book"

The product is considered to be transferred
either when the physical hand-over or
the transfer of ownership has taken place.
This transfer can be for payment or free of
charge, and it can be based on any type of
legal instrument. Thus, a transfer of a product
is considered to have taken place, for
instance, in the circumstances of sale, loan,
hire, leasing and gift.

Also from the blue book:
Placing on the market is considered not
to take place where a product is:
...
displayed at trade fairs, exhibitions or demonstrations.
(footnote 35)
However, in such
circumstances a visible
sign must clearly
indicate that the
product in question
may not be placed on
the market or put into
service until it has
been made to comply.

What if you rent it on a 99 year lease and it must be returned at the
end of the lease?

You may be able to send it "for demo purposes only, not for resale" but
it must be clearly labelled as such.

Subject: [LF] Placed on market question

I was asked to pose the following question to the Leadfree forum.

Can a non RoHS compliant device be placed on the market if it is only a
temporary assignment (30-45 days) and title to the device will not be
transferred from the original owner? There will be a short term lease
and the device will be returned to the original owner outside of the EU.
