Scope
1. This Directive shall apply to electrical and electronic
equipment falling under the categories set out in Annex IA
provided that the equipment concerned is not part of another
type of equipment that does not fall within the scope of this
Directive. Annex IB contains a list of products which fall under
the categories set out in Annex IA.

2. This Directive shall apply without prejudice to Community
legislation on safety and health requirements and specific
Community waste management legislation.

3. Equipment which is connected with the protection of the
essential interests of the security of Member States, arms, munitions
and war material shall be excluded from this Directive.
This does not, however, apply to products which are not
intended for specifically military purposes.




What you refer to is a Definition.



They may consider microphones etc as being not complete functioning
items within their own right and not covered under any of the
categories.............. although quite frankly to me they are Cat4.

Seems a bit odd that I must admit. DO you know which two countries these
were?

Also I thought the scope said "If it needs electrical power then it's in
scope". Or was it a vain hope that I thought I'd found the one simple
aspect of this whole legislative nightmare?!?!?

How can 2 countries rule that a item doesn't not apply?

Doesn't a decision like that rest with the main environmental EU body
and not the member states?

Yes they do as a matter of fact, although I believe that two countries
have
ruled that the power cords do not, which I find surprising.
