It's a European Commission FAQ document regarding the RoHS & WEEE
Directives.
(Question 2.1 is  What does "put on the market" mean?)

They say making a product available  "refers to each individual piece of
equipment, and not the launch of a new product or product line".

They also say that a product is "made available" when a "physical handover"
or "transfer of ownership" occurs from the Manufacturer (or mfg rep) to the
importer, or person responsible for distributing the product in the
community market.  "The transfer may also take place from the manufacturer
(or mfg rep) directly to the final consumer or user".

        Our company management is still struggling with the term "put on the
        market".  I have seen this interpreted as " the initial action of

        a product available for the first time on the community market, with
a
        view to distribution or use in the community". Our product was
designed
        and introduced into the European market fifteen years ago, therefore
is
        it exempt from RoHS and WEEE?  Do the Directives refer to new
products
        only?  Where can I find clarification with regard to new and old
product
        requirements?
