Maybe we are a bit mixed up with the terminology here..... what I mean
is that the EP has a certain period of time to scrutinise the Decision
before the final version is published.

Yes it has been adopted by default as it was not challenged within the
time allocation.

Copy attached in pdf or go to Europa and pick it up if the attachment
gets blown away.

Hi Jerry,

on September 23rd 2004 there was published a "Proposal for a Council
Decision amending the Directive 2002/95/EC" which means an amendment to
the RoHS. In this amendment is stated, that the following note should be
added:

In the Annex to Directive 2002/95/EC the following note is added:

"For the purpose of Article 5(1)(a), a maximum concentration value of
0.1% by weight in homogeneous materials for lead, mercury, hexavalent
chromium, polybrominated biphenyls (PBB) and polybrominated diphenyl
ethers (PBDE) and of 0.01% by weight in homogeneous materials for
cadmium shall be tolerated."

This is the plain text of the proposal for the amendment, nowhere is
stated a "intentionally added". This proposal is now in decision by the
Council and there have to be a decision not later than three months
after referral of the proposal. This means there have to be a decision
until December 23rd 2004.
