the link you specified leads to a consultation request, so the quoted limits
are up to now only proposed, not legitimised. There is no agreement yet. In
the german legislation proposal dated July 9, 2004 ("Referentenentwurf")
there is a footnote on page 5, which reads
2 Anm.: Eine Entscheidung der Europäischen Kommission über Grenzwerte für
die einzelnen Stoffe liegt noch nicht vor. § 5 setzt die Richtlinie
95/2002/EG (RoHS) um. Die Richtlinie basiert auf Art. 95 EG und muss deshalb
harmonisiert umgesetzt werden. Eine Festsetzung von Grenzwerten ist derzeit
deshalb noch nicht möglich.
By the way, a press note confirms that the german government will not be
able to issue the law by august 13, 2004; legislation will be finalised by
the end of 2004. This means even longer dwell time in the twilight zone...
