On April 10, 2001, King & Spalding filed a suit in Washington DC on behalf of
36 trade associations.  The IPC spearheaded this effort to restore reason to
the Toxics Release Inventory reporting thresholds for lead processing or use.
The new EPA requirement is 10 pounds per year, down from 10,000 or more.  The
cost of compliance will drive many small businesses out of business, without
reducing the use of lead by one ounce.  It's another senseless, bureaucratic
nightmare whose timing stems from this administration's political need to
appear holier than the previous one.  Something, apparently, had to be done
after the storm of protest when the U.S. intention to withdraw from the Kyoto
protocol (re greenhouse gas emissions) was announced.

It turns out that the underlying premise of the EPA is exactly the same as
that of the lead-free solder initiatives in Europe and Japan.  The EPA's way
of "banning" lead is just more sneaky.  As in all cases, misinformed,
unthinking, so-called environmentalist public interest groups must be
politically pleased.  The premise is that lead is a PBT chemical, persistent,
bioaccumulative, toxic.  Paragraph 13 of the complaint, among others, puts
the lie to this premise.  It's worth quoting, in part.

....."In January 2000, EPA co-sponsored an "Experts Workshop" during which
numerous scientific experts explained why application of the PBT methodology
to metals is not consistent with sound science."
