PLEASE NOTE Although the document is a possible 4th draft it has yet to be
adopted.

Adoption of the next draft (4th) of the WEEE directive was expected at
Easter but is now due within a few weeks - possibly before the end of May.
Formal agreement within the Commission must be achieved, in particular
between the Enterprise (Industry) and the Environment Directorates. This
draft proposal may include a delay in the proposed lead phase-out period to
2008.
In the meantime, the Enterprise Directorate has circulated a draft document
on the impact on the environment of Electrical and Electronic Waste (EEE).
The fate of this EEE initiative is not clear. The document aims to ensure
free movement of goods with no in-built restrictions on environmental
grounds. However, any EEE should undergo a conformity assessment according
to internal design rules or an environmental management system. The basic
requirements are for avoidance of use of materials that may pose a threat to
the environment, minimization of pollution and energy consumption. Member
States may consider that certain EEE should be restricted for reasons of
protection of the environment and that in such cases the manufacturer shall
be informed of Member State conditions.
