Thanks for the quickie answer. Let me clarify that company XYZ is the
consumer and has many locations. The product is used to scan and label their
products. The item has a long lifetime and can be used at any of the
company's stores after purchase from us.

I like the easy ones.
The product would be "placed on the Market" in December of 2007 since
that is when it forst entered the EU market and would need to comply
with the applicable portions of RoHS and WEEE to be legally imported.

Hey all

Here is a question that arose the other day. Our company sells an item
that
is non-compliant to company XYZ, serial #000001. Say the item is
purchased
in November 2006 by XYZ offices in Michigan. The product is moved from
Michigan for use at Company XYZ offices in California after January
2007. In
December of 2007 the item with serial #000001 is moved to offices in
England
since the California office is closed due to down sizing. What would the
various governing bodies decide as to the relevance of the compliance?
Yes
the item has the WEEE label on it!!

My response since it is used equipment and as long as company XYZ keeps
the
item it is exempt from EU and California legislation as they stand
today. If
Company XYZ sells it as used, company XYZ is responsible for any
questions
from then on.

What would be nice is a link to maybe the metal finishing forum that
discusses many different approaches and suppliers. Also some technical
