Anders:

I believe the answer depends on whether the UPS is incorporated into a 
"large-scale, fixed installation" or if it is a stand-alone product which 
could be moved from place to place.  If it's the former, it would not fall 
under RoHS; if it's the latter, it would fall under RoHS.
