If the equipment was placed on the market prior to the July deadline and
subsequently sold then it may be subsequently redeployed or sold as
second-hand (i.e. without major refurb to as new condition), then the
equip may move freely through member states.

Yes in regards to state. If I understand the EU, this would be an
applicable
question as well, since some of our EU customers have presence in more
than
one country in the EU. I think that the "used equipment" definition
would
allow the transfer from one customer location to another.

This forum is really EU RoHS centric and moreover "RoHS" per se refers
to the EU directive (in most peoples minds).

It reads like you are questioning USA State legislation??

I have been reviewing the details of the first couple of States RoHS
laws
(CA, TX).    The question has come up on our major accounts of whether
one
can redeploy used non-RoHS equipment from a store outside of one of the
states to inside after their RoHS laws take effect.

Specific example.  Could for instance a department stores take a
non-RoHS IT
unit that they have in, say, Arizona and move it to a CA store location?
