Steve,
My suggestions:
1. Use a CAM tool (Gerbtool, CAM350) to verify and edit your silkscreen layer. These tools allow you to set a clearance requirement for silkscreen features (to pad or soldermask opening) and will automatically remove any conflicts.
2. Include a note on your fabrication specification stating that silkscreen is not permitted on exposed conductive surfaces.
